Terms & Conditions

Effective Date: August 24th, 2025

Welcome to Amazing Liquidators. By using this website or purchasing from us, you agree to the following Terms & Conditions. Please review them carefully. If you do not agree, you should not use this site or engage in transactions with us.

1. Entire Agreement

These Terms & Conditions, along with any written order confirmations or invoices issued by Amazing Liquidators, form the complete and final agreement between the buyer and Amazing Liquidators. No verbal statements, purchase orders, or outside terms apply unless confirmed in writing by an authorized representative.

2. Website Use

This website is provided for informational and business purposes only. Users agree not to engage in unlawful activities, attempt to disrupt website functionality, or use the site in a manner that could cause harm. Amazing Liquidators reserves the right to restrict, suspend, or terminate access at any time.

3. Quotes, Orders & Acceptance

  • Quotes are valid for 10 days unless otherwise stated. After that period, they may expire or be revised.

  • No order is binding until Amazing Liquidators issues written confirmation.

  • We reserve the right to decline or cancel orders at our discretion.

4. Equipment Condition & Inspection

  • All equipment is sold “as-is, where-is, with all faults.”

  • Descriptions, images, and specifications are provided for reference only and do not constitute warranties.

  • Buyers are strongly encouraged to inspect items prior to purchase, either in person or through an appointed agent.

5. Delivery, Installments & Risk of Loss

  • Buyers are responsible for shipping, insurance, customs, handling, and all related costs.

  • Risk of loss passes to the buyer once the equipment is released to a carrier or picked up from our facility, even if Amazing Liquidators assists with arrangements.

  • Deliveries may be made in installments. Each installment is treated as a separate order and must be accepted and paid for independently.

  • If a third-party supplier fails to deliver equipment, our sole responsibility is to refund any deposits related to that item.

6. Payment Terms

  • Payment is due according to invoice terms and must be made in U.S. dollars.

  • Late payments may be subject to interest charges (up to 1.5% per month or the maximum permitted by law), collection costs, and suspension of future orders.

  • Buyers may not withhold or offset payments against other claims or disputes.

7. Taxes & Fees

The buyer is responsible for all applicable sales, use, excise, customs, and similar taxes or fees. Valid tax-exemption certificates must be submitted prior to invoicing; otherwise, applicable taxes will be charged.

8. Use, Safety & Compliance

  • The buyer assumes full responsibility for safe use, installation, and operation of purchased equipment.

  • The buyer agrees to comply with all relevant federal, state, and local laws, regulations, and safety standards.

  • The buyer agrees to indemnify and hold Amazing Liquidators harmless from any claims, damages, injuries, or liabilities arising from the use, handling, transport, or resale of equipment.

9. Insurance & Site Access

If the buyer or its representatives enter our premises for inspection, pickup, or loading, they do so at their own risk. Buyers must carry appropriate liability and workers’ compensation insurance and accept full responsibility for injuries, accidents, or damages that may occur.

10. Intellectual Property

All website content, including text, images, graphics, designs, and logos, is the property of Amazing Liquidators unless otherwise noted. No materials may be copied, distributed, or modified without prior written permission.

11. Third-Party Links

This website may contain links to third-party websites. These are provided for convenience only. Amazing Liquidators is not responsible for the content, practices, or security of external websites.

12. Limitation of Liability

  • Amazing Liquidators makes no warranties, express or implied, regarding the equipment sold.

  • We are not liable for indirect, incidental, or consequential damages, including lost profits, business interruption, or personal injury.

  • In no event shall our liability exceed the purchase price of the equipment sold.

13. Force Majeure

We are not responsible for delays or failure to perform caused by events beyond our control, including but not limited to natural disasters, labor disputes, supply chain disruptions, acts of terrorism, or government restrictions.

14. Export & Sanctions Compliance

Buyers are responsible for complying with all U.S. export controls, trade sanctions, and import laws. Amazing Liquidators reserves the right to cancel orders if fulfilling them would violate applicable laws or regulations.

15. Governing Law & Dispute Resolution

  • These Terms & Conditions shall be governed by and interpreted under the laws of the State of Illinois.

  • Any disputes shall be resolved in state or federal courts located in Cook County, Illinois, unless otherwise required by law.

  • At our discretion, disputes may alternatively be resolved through binding arbitration under JAMS rules in Chicago, Illinois.

16. Severability & No Agency

If any provision of these Terms & Conditions is found unenforceable, the remaining provisions will remain in full effect. Nothing in these Terms creates a partnership, joint venture, or agency relationship between the buyer and Amazing Liquidators.

17. Updates to These Terms

Amazing Liquidators may revise these Terms & Conditions from time to time. Updated versions will be posted on this page with a revised effective date.
